Do you taste that? It’s victory (with a slight tinge of coffee, it is the morning after all). The US has made not so much a leap into 2010 as a mild, uncomfortable shuffle. But it’s still a shuffle in the right direction.

Chief US District Judge Vaughn Walker released a 136 page decision to overturn the ban on same-sex marriage in California. He called proposition 8, the 2008 clause where “Only marriage between a man and a woman is valid or recognized in California,” unconstitutional. The ruling reads:

Marriage in the United States has always been a civil matter. Civil authorities may permit religious leaders to solemnize marriages but not to determine who may enter or leave a civil marriage. Religious leaders may determine independently whether to recognize a civil marriage or divorce but that recognition or lack thereof has no effect on the relationship under state law.

Separation of church and state? It almost seems too good to be true. Unfortunately same-sex couples can’t run out and tie the knot quite yet. Walker attached a stay to his ruling. For the next few days there will be a freeze on same-sex marriages until a hearing can be held on whether to allow these marriages while the case is being appealed. And appealed it will be. The case is expected to make it to the Supreme Court.

For now we’ll celebrate with our favorite girlfriend and keep our fingers (but not our legs) crossed.
